Legal framework
There is no specific legislation in relation to Marine Spatial Planning, but it is covered by the following legislation:
- Political Constitution of the Republic
- National Ocean Policy: approved by Decree No. 74 of 2018 of the Ministry of Foreign Affairs
- National Policy on Coastal Zone Management: approved by Decree No. 475 of 1994 of the Ministry of Defence
- Law 21.600 that creates the Biodiversity and Protected Areas Service and the National System of Protected Areas (2023)
- Law Nº 18.892, General Law on Fishing and Aquaculture and its modifications (Supreme Decree Nº 430 – 1991), of the Ministry of Economy, Development and Reconstruction
- Decree Law Nº 2.222, of 1978, of the Ministry of National Defence, which Replaces the Navigation Law and its modifications.
