Legal framework

The Law of the People’s Republic of China on the Administration of the Use of Sea Areas forms the fundamental basis of China’s sea area management and establishes the basic management system of China’s sea area management. This law confirms the legal status of Marine Functional Zoning (MFZ) in China. When any organization or individual submits a sea use application to the government, they must comply with MFZ.

The Marine Environmental Protection Law of the P.R.C stipulates that the preparation of a marine environmental protection plan should be in accordance with MFZ; the development and utilization of marine resources shall be rationally arranged in accordance with MFZ.

The Sea Island Protection Law of the P.R.C stipulates that in accordance with the national economic and social development plan and national MFZ, organize the compilation of national offshore Islands protection plan.
